STORE TERMS AND CONDITIONS

1. General Provisions

1.1. These terms and conditions (hereinafter referred to as the “Terms”) apply to contracts concluded by the Seller within the framework of its business activities via a means of distance communication – the Internet.

1.2. The following definitions are adopted in these Terms:

* Client – means any natural or legal person or organizational unit with legal personality, including a natural person purchasing an item for purposes not directly related to their business or professional activity.
* Seller – HASPRO Sp. z o.o., headquartered in Rzeszów at ul. Hoffmanowej 19/302, registered by the District Court in Rzeszów, Commercial Division of the National Court Register under KRS 0000506537, with NIP: 8133690812 and REGON 181100422, conducting business involving the sale of movable goods at a distance via the Internet or through a representative authorized to perform all actions related to the concluded Contract.
* Contract – a civil law contract concluded via a means of mass communication at a distance via the Internet.
* Internet – a means of direct distance communication based on a technical connection used to transmit information in the form of electrical impulses over a distance.
* Registration – actual actions taken by the entity to identify itself and prepare to submit an explicit and unambiguous declaration of intent, performed by the Client using a form provided by the Seller.
* Domain – the designation assigned to the Seller on the Internet, in the form of linking [www.hasproearplugs.com](http://www.hasproearplugs.com) with the Seller.
* Object of sale – a movable item or items the Client selects by moving them to the appropriate section of the form, thereby accepting the offer to conclude a contract.
* Account – granted automatically by the Seller upon the Client’s request, providing free and exclusive access to parts and functions of the domain, assigned after registration in the domain.

2. Registration

2.1. A Client intending to conclude a Contract with the Seller provides their data in the form and is obliged to read these Terms, made available in a manner allowing saving and retrieval.

2.2. The registration form is provided by the Seller on its website operating under the domain: [www.hasproearplugs.com](http://www.hasproearplugs.com).

2.3. During registration, the Client provides personal data indicated in the form, including name and surname or business name, residence or registered office address, e-mail address, phone number for contact, and optionally a correspondence address. By submitting their data, the Client consents to its processing by the Seller for purposes related to the conclusion and performance of the Contract.

2.4. Providing the data in 2.3 is voluntary. Failure to provide certain data may prevent account registration and result in refusal to conclude the Contract.

2.5. After successful registration, the Client gains access to their Account, enabling them to conclude Contracts with the Seller. Registration and use of the Account are free of charge.

2.6. The Client has the right to access, modify, or permanently delete their personal data at any time. Deleted data are not further processed, except for data needed to document sales or for tax purposes.

2.7. The Seller is the administrator of the Client’s personal data and has implemented appropriate organizational and technical measures to protect the data. The data collection is registered with the General Inspector for Personal Data Protection under No. 145067.

2.8. Personal data are processed solely for purposes related to the conclusion and performance of the Contract and for using the Account.

3. Conclusion of the Contract

3.1. The Contract is concluded at the Client’s request after account registration, by selecting and accepting the item, which constitutes acceptance of the Seller’s offer, indicated by placing the item in the designated area of their Account.

3.2. The Contract is concluded at the moment the Client clicks the button confirming the Contract, after marking “order” in the form.

3.3. The Contracting party is the person whose personal data were provided in the registration form as the Client.

3.4. The Seller must send confirmation of the Contract conditions to the Client’s e-mail within 7 days. Failure to do so is considered withdrawal from the Contract by the Seller.

3.5. The Client has the right and obligation to review and accept the Contract conditions using distance communication tools.

4. Performance of the Contract

4.1. Delivery of available items occurs within 7 days from the Client’s confirmation and payment. Custom-made items may require additional time.

4.2. The Client may choose delivery via public courier (e.g., Poczta Polska S.A.) or another courier service.

4.3. Delivery instructions are indicated by updating the Client’s Account.

4.4. The Seller may add delivery costs to the purchase price, communicated in the confirmation email.

4.5. If the Client does not provide a delivery address, the Seller will send the item to the registered address.

4.6. The Seller provides proof of transaction in the form of a receipt or, upon request, a VAT invoice.

5. Payment

5.1. Payment may be made via bank transfer to Alior Bank PL 60249000050000452080108620 or via online payment operator DotPay S.A.

5.2. Payment may also be made on delivery to the courier.

5.3. The Client chooses the payment method in their acceptance of the offer through the online form.

6. Withdrawal from the Contract

6.1. Clients purchasing for non-business purposes have the right to withdraw within 10 days from receipt.

6.2. Returned items must be sent within 14 days. Posting via postal operator is sufficient.

6.3. The Client bears return shipping costs.

6.4. Costs must not exceed standard shipping rates.

6.5. Withdrawal may also be made via the “cancel order” form field before confirmation.

6.6. Failure to confirm the Contract is treated as withdrawal.

6.7. Withdrawal rights do not apply to customized items or items tailored to the Client’s specifications.

6.8. Pursuant to Art. 38 of the Consumer Rights Act, withdrawal does not apply to non-prefabricated items made to consumer specifications.

7. Seller’s Liability for Nonconformity

7.1. Seller is liable if the item does not match the Contract for non-business Clients.

7.2. Clients may demand repair or replacement.

7.3. If compliance cannot be achieved timely, the Client may request a price reduction or withdraw, except for customized items.

7.5. Withdrawal provisions in section 6 apply accordingly.

8. Warranty for Defects

8.1. Business Clients have the right to withdraw, request a defect-free item, or reduce the price for defective goods.

8.2. Defects include reduced value, missing promised properties, third-party claims, or encumbrances.

8.4. Withdrawal provisions in section 6 apply accordingly.

9. Quality Guarantee

9.1. Seller guarantees items have the properties indicated in the online offer.

9.2. Clients have the right to replacement if items are defective.

9.3. Guarantee period: 24 months from the Contract date.

9.4. Proof of guarantee: receipt or VAT invoice.

9.5. Guarantee does not limit rights for non-business Clients regarding nonconformity.

9.6. Guarantee does not limit business Clients’ rights under defect liability.

10. Final Provisions

10.1. Disputes with non-business Clients are subject to Arbitration Courts at Provincial Trade Inspection Offices based on residence.

10.2. Disputes with business Clients are subject to general courts.

10.3. Changes to Terms require written form, website posting, and e-mail notification to Clients who have not yet received items.

10.4. Terms are available on the Seller’s website and must be read before concluding a Contract, confirmed via the online form.

10.5. Matters not covered by these Terms are governed by applicable law, including the Civil Code, the Act on Electronic Services, and the Consumer Sales Act.
